1. Company & Service

Learnerr is provided by Learnerr (Pvt) Ltd., a company incorporated under the laws of Sri Lanka. Our platform, Learnerr, combines a comprehensive learning management system with built-in video-conferencing functionality to support educators and learners in creating, delivering, and attending online courses through a unified interface.

2. User Definitions & Eligibility

The Service is available to any individual or organization that wishes to register for an account, including students who enroll in classes, teachers who design and deliver course content, and administrators who manage class schedules and user roles. By using Learnerr, you represent that you are at least eighteen years old (or the legal age of majority in your jurisdiction) and that you have the authority to enter into a binding agreement under these Terms.

3. Account & Access

To begin using Learnerr, you must complete our registration form by providing a valid email address, choosing a secure password, and supplying any other information we deem necessary to verify your identity. You agree to keep your login credentials confidential and to notify us immediately if you suspect that your account has been accessed without authorization. You accept responsibility for all activity under your account and for ensuring that no one else gains access to your credentials or uses your account in violation of these Terms.

4. Subscription Plans & Billing

Learnerr offers a range of monthly subscription plans, with detailed pricing information accessible on the Accounts & Billing page once you have logged into the Service. All payments are processed online via the PayHere gateway, and each subscription period covers the first day through the last day of the calendar month. Unless you cancel your subscription before the start of a new billing cycle, your plan will renew automatically. If you find the Service unsatisfactory, you may request a one-time refund during your very first month of service by contacting our support team before your second billing date; unfortunately, refunds are not available beyond that initial period.

5. Acceptable Use & Prohibited Activities

You may use Learnerr only for lawful purposes in connection with educational activities. In particular, you must not send unsolicited bulk or spam communications through our messaging tools, nor should you upload or share any content that is unlawful, defamatory, obscene, or infringes on the rights of others. Excessive use of streaming features that degrades service quality for other users is also prohibited. Furthermore, you must not engage in harassment, hacking, distribution of malware, or any conduct that violates applicable intellectual property laws or interferes with the security or integrity of our systems.

6. Intellectual Property

All software code, designs, logos, trademarks, and other content provided through Learnerr are and shall remain the exclusive property of Learnerr (Pvt) Ltd. Under these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service strictly for your own internal educational needs. Should you violate these Terms, we reserve the right to suspend or terminate that license at our discretion. By uploading or submitting any materials—such as documents, videos, quizzes, or presentations—you grant Learnerr a worldwide, royalty-free right and license to host, store, stream, display, reproduce, and distribute that content solely for the purpose of delivering the Service.

7. Privacy & Data Handling

Your privacy is important to us. Our comprehensive Privacy Policy, which can be reviewed at https://learnerr.io/privacy, describes the categories of personal information we collect (including registration details, payment data, and usage analytics), the purposes for which we process that data, and the circumstances under which we may share information with third parties. We comply with Sri Lanka’s Personal Data Protection Act (PDPA) and applicable international regulations, such as the GDPR, in handling your data. To safeguard your information, we implement industry-standard encryption, regular backups, and strict access controls, and we retain your data only for as long as your account remains active or as required by law.

8. Indemnification

You agree to defend, indemnify, and hold harmless Learnerr (Pvt) Ltd., its officers, directors, employees, and agents from any losses, damages, liabilities, claims, or expenses (including reasonable attorneys’ fees) arising out of or related to your use of Learnerr, your breach of these Terms, or your violation of any rights of another party, in each case under the applicable laws of Sri Lanka.

9. Term & Termination

We may suspend or terminate your access to all or part of the Service at any time and without prior notice if you breach these Terms or if we choose to discontinue the Service. Upon termination, your right to use the Service immediately ceases, and all data associated with your account will be irretrievably deleted; you acknowledge and agree that we shall have no liability to you for any such deletion of data or termination of access.

10. Modification of Terms

From time to time, we may revise these Terms to reflect changes in our business practices or legal requirements. When material changes are made, we will notify you via the email address associated with your account at least thirty days before those changes take effect. If you do not agree with any modified Terms, you must discontinue your use of the Service; continued use after the effective date constitutes acceptance of the updated Terms.

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Sri Lanka without regard to its conflict of law principles. Any dispute arising under or relating to these Terms or your use of Learnerr shall be subject to the exclusive jurisdiction of the courts of Colombo, Sri Lanka.
